• IMPORTANT NOTICE ON AMENDMENT OF TERMS AND CONDITIONS RELATING TO THE FEATURES AND REWARDS AVAILABLE UNDER THE CIMB TESCO DEBIT MASTERCARD & CIMB TESCO SAVERS ACCOUNT

Date of Notice: 31 January 2019

Dear Valued Customers,

Please be informed that CIMB Bank Berhad’s Terms and Conditions relating to the Features and Rewards available under the CIMB Tesco Debit Mastercard & CIMB Tesco Savers Account (“Terms and Conditions”) have been amended. For ease of reference, the amended clause is as set out in the table below. The amended Terms and Conditions shall take effect and be binding after twenty one (21) calendar days from the date of this notice i.e. 22 February 2019.

Amendment on Clause 2.5, 2.10 (a), 2.10 (b), 2.14 and 3.4.

Clause 2.5

Cardholder must be a Tesco Clubcard member and has updated his/her Tesco Clubcard number with CIMB to be entitled to receive the Clubcard Points.

The Cardholder must be a Tesco Clubcard member and must ensure that his/her Tesco Clubcard number is updated in CIMB’s records to be entitled to receive the Clubcard Points.

 
Clause 2.10 (a) Clubcard Points earned pursuant to transactions charged using the Tesco Co-Brand Debit Card will be credited to the Cardholder’s Tesco Clubcard account Clubcard Points earned pursuant to transactions charged using the Tesco Co-Brand Debit Card will be credited to the Cardholder’s Tesco Clubcard account, provided the Cardholder is a Tesco Clubcard member and his/her Tesco Clubcard number has been updated with CIMB.  
Clause 2.10 (b)

It is the responsibility of each of the Cardholder to provide CIMB with accurate information including his/her Tesco Clubcard number in order for the same to be recorded by CIMB. In the event of a lost or replaced Tesco Clubcard, the Cardholder shall be responsible to update his/her new Tesco Clubcard number with CIMB. CIMB reserves the right to forfeit the Clubcard Point(s) earned by the Cardholder in the event of the Cardholder’s failure to update the relevant information and/or to provide accurate Tesco Clubcard number to CIMB. The Cardholders may contact CIMB’s customer service number stipulated at the back of their Tesco Co-Brand Debit Card to update their records.

 

It is the responsibility of each of the Cardholders to ensure the accuracy of the Tesco Clubcard number recorded in CIMB’s records in order to earn Clubcard Points. Cardholders may contact CIMB’s customer service number stipulated at the back of their Tesco Co-Brand Debit Card to update CIMB’s records. Cardholders acknowledge and agree that CIMB reserves the right to update its records based on the Cardholder’s Tesco Clubcard number provided by Tesco to CIMB. Notwithstanding the aforesaid, it is the Cardholder’s sole responsibility to ensure the accuracy of the Tesco Clubcard number recorded in CIMB’s records and CIMB disclaims any liability arising as a result of any inaccurate Tesco Clubcard number updated in its records based on the information provided by Tesco. No Clubcard Points will be earned before CIMB’s updating of its records of the Cardholder’s Tesco Clubcard number. In the event of a lost or replaced Tesco Clubcard, the Cardholder shall be responsible to update his/her new Tesco Clubcard number with CIMB. CIMB will forfeit Clubcard Point(s) earned in the event of the Cardholder’s failure to update and/or failure to ensure the accuracy of the Cardholder’s Tesco Clubcard number maintained in CIMB’s records.

 
Clause 2.14

The Tesco Clubcard is owned and operated by Tesco. The term and conditions governing the use of Clubcard Point(s) can be found on Tesco’s website at www.tesco.com.my. For any enquiries relating to Tesco Clubcard and/or Clubcard Points, the Cardholder may call Tesco’s Clubcard Helpline at 1 300 13 1313. Tesco reserves the right to vary the said terms and conditions at any time for legal, regulatory, business or policy reasons.

 

The Tesco Clubcard is owned and operated by Tesco. Cardholders acknowledge and agree that Tesco shall have the right to contact Cardholders on the application of a Tesco Clubcard, to enable Cardholders to fully enjoy the rewards, services and benefits offered under the Tesco Co-Brand Debit Card, and to disclose and update the Cardholder’s Tesco Clubcard number to CIMB. The term and conditions governing the use of Clubcard Point(s) issued by Tesco can be found on Tesco’s website at www.tesco.com.my. For any enquiries relating to Tesco Clubcard and/or Clubcard Points, the Cardholder may call Tesco’s Clubcard Helpline at 1 300 13 1313. Tesco reserves the right to vary the said terms and conditions at any time for legal, regulatory, business or policy reasons.   
Clause 3.4 CIMB reserves the right to share the Cardholder’s information including but not limited to name, mobile number,date of birth, address, email address,Tesco Clubcard number and Clubcard points with Tesco, its agents or any of its related companies for the purposes of crediting of Clubcard Points and enabling the Cardholder to enjoy the rewards, services and benefits offered under the Tesco Savers Account and Tesco Co-Brand Debit Card. CIMB reserves the right to share the Cardholder’s relevant information including but not limited to name, mobile number, date of birth, address, email address, the Cardholder’s Tesco Clubcard number and number of Clubcard Points earned per month with Tesco, its successors, their agents or any of its related companies, for the purpose of facilitating Tesco’s crediting of Clubcard Points into the Cardholder’s Tesco Clubcard account to enable the Cardholder to fully enjoy the rewards, services and benefits offered under the Tesco Co-Brand Debit Card.

Dimaklumkan bahawa Terma dan Syarat CIMB Bank Berhad yang berkaitan dengan Ciri-ciri dan Ganjaran yang tersedia di bawah CIMB Tesco Debit Mastercard & CIMB Tesco Savers Account (“Terma dan Syarat”) telah dipinda. Untuk memudahkan rujukan, klausa-klausa yang dipinda adalah dinyatakan dalam jadual di bawah. Terma dan Syarat baru ini akan berkuatkuasa dan dianggap muktamad selepas 21 hari kalendar dari tarikh notis in i.e. 22 Februari 2019.

Klausa 2.5

Pemegang Kad hendaklah ahli Tesco Clubcard dan telah mengemaskinikan nombor Tesco Clubcard beliau dengan CIMB supaya berhak menerima Mata Clubcard.

Pemegang Kad hendaklah ahli Tesco Clubcard dan mesti memastikan nombor Tesco Clubcard beliau dikemas kini dengan CIMB supaya berhak menerima Mata Clubcard.

 
Klausa 2.10 (a) Mata Clubcard yang diperolehi selaras dengan transaksi yang dicaj menggunakan Kad Debit Jenama Bersama Tesco akan dikreditkan ke dalam akaun Tesco Clubcard Pemegang Akaun. Mata Clubcard yang diperolehi selaras dengan transaksi yang dicaj menggunakan Kad Debit Jenama Bersama Tesco akan dikreditkan ke dalam akaun Tesco Clubcard Pemegang Akaun, dengan syarat Pemegang Akaun adalah ahli Tesco Clubcard dan nombor Tesco Clubcard telah dikemas kini dengan CIMB.

Setiap Pemegang Kad bertanggungjawab memberikan kepada CIMB maklumat yang tepat termasuk nombor Tesco Clubcard beliau supaya maklumat ini boleh direkodkan oleh CIMB. Sekiranya Tesco Clubcard hilang atau digantikan, Pemegang Kad bertanggungjawab mengemaskinikan nombor Tesco Clubcard baru beliau dengan CIMB. CIMB berhak menarik balik Mata Clubcard yang diperolehi oleh Pemegang Kad sekiranya Pemegang Kad gagal mengemaskinikan maklumat relevan dan/atau menyediakan nombor Tesco Clubcard yang tepat kepada CIMB. Pemegang Kad boleh menghubungi nombor perkhidmatan pelanggan CIMB yang dinyatakan di belakang Kad Debit Jenama Bersama Tesco mereka untuk mengemaskinikan rekod mereka.

 

Setiap Pemegang Kad bertanggungjawab memastikan ketepatan nombor Tesco Clubcard yang direkodkan dalam rekod CIMB untuk mendapatkan Mata Clubcard. Pemegang Kad boleh menghubungi nombor perkhidmatan pelanggan CIMB yang dinyatakan di belakang Kad Debit Jenama Bersama Tesco mereka untuk mengemaskinikan rekod CIMB. Pemegang Kad mengakui dan bersetuju bahawa CIMB berhak mengemaskini rekodnya berdasarkan nombor Tesco Clubcard beliau yang disediakan oleh Tesco kepada CIMB. Walau apa yang disebut terdahulu, ia adalah tanggungjawab Pemegang Kad untuk memastikan ketepatan nombor Tesco Clubcard yang direkodkan dalam rekod CIMB dan CIMB menafikan apa-apa liabiliti yang timbul hasil daripada mana-mana nombor Tesco Clubcard yang tidak tepat dikemaskini dalam rekodnya berdasarkan maklumat yang diberi oleh Tesco. Tiada Mata Clubcard akan diperolehi sebelum pengemaskinian rekod CIMB mengenai nombor Tesco Clubcard Pemegang Kad. Sekiranya Tesco Clubcard hilang atau digantikan, Pemegang Kad bertanggungjawab mengemaskinikan nombor Tesco Clubcard baru beliau dengan CIMB. CIMB akan menarik balik Mata Clubcard yang diperolehi sekiranya Pemegang Kad gagal mengemaskinikan dan/atau gagal untuk memastikan ketepatan nombor Tesco Clubcard beliau yang dikekalkan dalam rekod CIMB.

Tesco Clubcard dimiliki dan dikendalikan oleh Tesco. Terma-terma dan syarat-syarat yang mengawal penggunaan Mata Clubcard boleh didapati di laman web Tesco di www.tesco.com.my. Untuk sebarang pertanyaan berkaitan dengan Tesco Clubcard dan/atau Mata Clubcard, Pemegang Kad boleh menelefon Talian Clubcard Tesco di 1 300 13 1313. Tesco berhak mengubah terma-terma dan syarat-syarat tersebut pada bila-bila masa atas sebab undang-undang, kawal selia, perniagaan atau dasar.

 

Tesco Clubcard dimiliki dan dikendalikan oleh Tesco. Terma-terma dan syarat-syarat yang mengawal penggunaan Mata Clubcard boleh didapati di laman web Tesco di www.tesco.com.my. Untuk sebarang pertanyaan berkaitan dengan Tesco Clubcard dan/atau MataClubcard, Pemegang Kad boleh menelefon Talian Clubcard Tesco di 1 300 13 1313. Tesco berhak mengubah terma-terma dan syarat-syarat tersebut pada bila-bila masa atas sebab undang-undang, kawal selia, perniagaan atau dasar.

 

 
Klausa 3.4 CIMB berhak berkongsi maklumat Pemegang Kad termasuk tetapi tidak terhad kepada nama, nombor telefon mudah alih, tarikh lahir, alamat, alamat e-mel, nombor Tesco Clubcard dan Mata Clubcard dengan Tesco, agennya atau mana-mana syarikat berkaitannya bagi tujuan mengkreditkan Mata Clubcard dan membolehkan Pemegang Kad menikmati ganjaran, perkhidmatan dan manfaat yang ditawarkan di bawahAkaun Tesco Savers dan Kad Debit Jenama Bersama Tesco. CIMB berhak berkongsi maklumat berkaitan Pemegang Kad termasuk tetapi tidak terhad kepada nama, nombor telefon mudah alih, tarikh lahir, alamat, alamat e-mel, nombor Tesco Clubcard Pemegang Kad dan bilangan Mata Clubcard yang diperoleh setiap bulan dengan Tesco, pengantinya, agen mereka atau mana-mana syarikat berkaitannya bagi memudahkan pengkreditan Mata Clubcard oleh Tesco ke dalam akaun Tesco Clubcard Pemegang Kad bagi membolehkan Pemegang Kad menikmati ganjaran, perkhidmatan dan manfaat yang ditawarkan di bawah Kad Debit Jenama Bersama Tesco.
